This website is operated by The Petal Press, LLC. Throughout the site, we, us and our refer to The Petal Press. We offer this website, including all information, tools and services available from it, to you, the user, on condition that you accept all the terms, conditions, policies and notices stated here.

By visiting our site or buying something from us, you engage in our Service and agree to be bound by these Terms of Service (the Terms), including the additional terms and policies referenced here or linked from here. These Terms apply to everyone who uses the site, including browsers, customers, vendors and contributors of content.

Please read these Terms carefully before using our website. If you do not agree to all of them, you may not use the website or any of our Services.

Any new features or tools added to the store are also covered by these Terms. You can review the most current version on this page at any time. We may update, change or replace any part of these Terms by posting the change to this page, and your continued use of the site after that constitutes acceptance of it.

Our store runs on WooCommerce, an e-commerce platform for WordPress, and is hosted by SiteGround. They provide the platform and hosting that let us sell our products and Services to you.

Using this website

By agreeing to these Terms, you confirm that you are at least the age of majority in the state where you live, or that you are the age of majority and have given us your consent to allow a minor in your care to use this site.

You may not use our products for any unlawful or unauthorized purpose, and you may not break any law in your jurisdiction, including copyright law, in the course of using the Service. You must not transmit any worm, virus or code of a destructive nature. A breach of these Terms results in immediate termination of your Services.

You may not reproduce, duplicate, copy, sell, resell or exploit any part of the Service, or any content on the website, without our express written permission. The headings in this agreement are for convenience only and do not affect its meaning.

We may refuse service to anyone, for any reason, at any time.

What the preservation service is

Floral preservation is a custom, hand-made service performed on materials you supply. It is not a stock product, and the terms in this section reflect that.

Each order is made to your specification: your flowers, your frame size, your frame color and finish. Because the work is specific to you, an order cannot be resold or reassigned once it has begun.

The work cannot be reversed. Pressing and drying permanently change your flowers. Once that has begun, your flowers cannot be returned to you in their original state.

Preservation takes time. On average, flower drop-off to frame delivery is 5 to 7 months. It varies with time of year, and whether ordered in advance or were accommodated as a last minute order. Timelines we give you are honest estimates based on our experience, not guaranteed delivery dates.

Colors change. When pressed, flowers may change shape, color, and even size. While not every color change is drastic, some may be surprising. White flowers turn hues of ivory, yellow, beige, which continues as they age. Varieties of pink and red flowers may turn different shades of purple. Some colors deepen in the press, while others fade to a softer version. All of our frames feature UV-protected conservation glass. This helps preserve the flowers' color for as long as possible. However, because flowers are 100% natural materials, color fading is expected as they naturally and gracefully age. Color change is an expected result of preservation rather than a defect.

We cannot guarantee a specific result. Every bouquet is different, and how a flower presses depends on its variety, its condition when it reaches us and how it was cared for beforehand. We will tell you honestly, before we begin, if we do not think your flowers will press well.

Getting your flowers to us

Delivering your flowers to our studio is your responsibility, whether you ship them or drop them off, and they are at your risk until they reach us.

Flowers must still be fresh. We accept flowers up to five days after your event, depending on condition and how they have been stored. Sooner is always better. When shipping flowers to us, use the carrier of your choice. Overnight shipping is recommended for best results. Please provide our team with a tracking link.

Our studio is appointment only. Drop-offs and pick-ups must be booked through the scheduling link in your confirmation email. If you arrive outside your window we cannot guarantee that anyone will be there to receive your flowers. Please contact us immediately to inquire about additional openings.

Approving your design

Once your flowers are dried, we design an arrangement for your blooms and your chosen frame, and send it to you. Nothing is sealed until you have seen the design and told us to proceed. Please review it carefully.

If we have not heard from you within two months of sending your design, we may seal and package your piece as designed so that it can be finished and returned to you. We will try to reach you multiple times before we do.

No additional changes can be made after the design has been approved.

Photographs of your work

We may photograph the arrangements we make and use those photographs to show our work, including on this site, in printed material and on social media. If you would prefer we did not use photographs of your order, please give us written notice and we will not.

Products, prices and availability

Some products or Services are available only online through this website. They may be offered in limited quantities and are subject to our Refund Policy.

Prices are subject to change without notice, and we may modify or discontinue any product or part of the Service at any time without notice. We will not be liable to you or to anyone else for a modification, price change, suspension or discontinuation.

We have made every effort to display the colors and images of our products as accurately as possible, but we cannot guarantee that your screen will show any color accurately.

We may limit the sale of our products or Services to any person, region or jurisdiction, and we may limit quantities, on a case-by-case basis. We may discontinue any product at any time. Any offer made on this site is void where prohibited.

Gift cards

Gift cards are sold in amounts from $25 to $1,000 and can be used toward any preservation order on this site. They cannot be used to buy another gift card.

The money on a gift card does not expire, and we charge no fees on a gift card. There is no activation fee, no service fee and no inactivity or dormancy fee.

Gift cards are not redeemable for cash except where the law requires it. If you lose your gift card code, contact us for assistance.

Orders, billing and account information

We may refuse any order you place with us, and we may limit or cancel quantities bought per person, per household or per order, including orders placed under the same account, the same card, or the same billing or shipping address. If we change or cancel an order we will try to contact you using the email address or phone number you gave us. We may limit or prohibit orders that appear to be placed by dealers or resellers.

You agree to give current, complete and accurate purchase and account information for every purchase, and to keep it up to date so that we can complete your order and reach you when we need to.

Cancellations and refunds

You can cancel at no charge before your flowers reach us. Once your flowers arrive in our care, cancellations and refunds are not accepted, because the work is custom and cannot be undone. Our Refund Policy sets this out in full, along with what we do if your flowers arrive damaged or there is a problem with your finished frame, and it forms part of these Terms.

Accuracy of information on this site

We are not responsible if information on this site is not accurate, complete or current. The material here is for general information and should not be your only basis for a decision. Any reliance on it is at your own risk.

The site may contain historical information, which is not current and is provided for reference. We may change the contents of the site at any time, but we have no obligation to update any of it.

There may occasionally be typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times or availability. We may correct them, and change or cancel an order, at any time without prior notice, including after you have placed it.

Third-party tools and links

We may give you access to third-party tools that we neither monitor nor control. They are provided as is and as available with no warranty, representation or endorsement of any kind, and we have no liability arising from your use of them. Using them is at your own risk, and you should make sure you understand the third party's own terms.

Content, products and Services available through our Service may include material from third parties, and links on this site may take you to websites that are not affiliated with us. We are not responsible for examining or evaluating their content or accuracy, we give no warranty for them, and we are not liable for any harm arising from your dealings with them. Complaints about a third party's products should go to that third party.

Your comments and submissions

If you send us creative ideas, suggestions, proposals, plans or other material, whether at our request or not, you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium, without restriction. We are under no obligation to keep them confidential, to pay for them, or to respond to them.

We may, but are not obliged to, monitor, edit or remove content we consider unlawful, offensive, threatening, defamatory, obscene, otherwise objectionable, or in breach of anyone's intellectual property or these Terms.

You agree that your comments will not violate anyone's rights, including copyright, trademark, privacy or personality rights, and will not be unlawful, abusive or obscene or contain malware. You may not use a false email address or pretend to be someone else. You are solely responsible for anything you post and for its accuracy, and we take no responsibility for it.

Prohibited uses

In addition to the other prohibitions in these Terms, you may not use the site or its content: for any unlawful purpose; to ask others to take part in unlawful acts; to break any international, federal, state or local law, rule or regulation; to infringe our intellectual property rights or anyone else's; to harass, abuse, insult, harm, defame, intimidate or discriminate on the basis of gender, sexual orientation, religion, ethnicity, race, age, national origin or disability; to submit false or misleading information; to upload or transmit viruses or any other malicious code; to collect or track other people's personal information; to spam, phish, pharm, pretext, spider, crawl or scrape; for any obscene or immoral purpose; or to interfere with or get around the security features of the Service or any related website. We may terminate your use of the Service for any of these.

Your submission of personal information through the store is governed by our Privacy Policy.

Disclaimer of warranties and limitation of liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free, or that the results obtained from using it will be accurate or reliable. We may remove the Service for indefinite periods or cancel it at any time without notice to you.

You expressly agree that your use of, or inability to use, the Service is at your sole risk. The Service and all products and Services delivered to you through it are, except where we expressly state otherwise, provided as is and as available, without any representation, warranty or condition of any kind, express or implied, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title and non-infringement.

In no case shall The Petal Press, or our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors, be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data, replacement costs or similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Service or any product obtained through it, or from any other claim related in any way to your use of the Service or any product, including any error or omission in any content, or any loss or damage of any kind incurred as a result of the use of the Service or any content or product made available through it, even if we have been advised of the possibility. Where a state or jurisdiction does not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify, defend and hold harmless The Petal Press and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

Severability

If any provision of these Terms is found to be unlawful, void or unenforceable, that provision is still enforceable to the fullest extent permitted by law, and the unenforceable part is severed from these Terms without affecting the validity and enforceability of anything else in them.

Termination

Obligations and liabilities incurred before the termination date survive the termination of this agreement for all purposes.

These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by telling us you no longer wish to use our Services, or by ceasing to use our site. If we judge, or suspect, that you have failed to comply with any part of these Terms, we may terminate this agreement at any time without notice, you will remain liable for all amounts due up to and including the date of termination, and we may deny you access to our Services.

Entire agreement

Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision.

These Terms, and any policies or operating rules we post on this site, are the entire agreement between you and us and govern your use of the Service, superseding any earlier agreements, communications and proposals, whether oral or written, including any prior version of these Terms. Ambiguities in these Terms will not be construed against the drafting party.

Governing law

These Terms, and any separate agreement under which we provide you Services, are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions.

Changes to these Terms

You can review the most current version of these Terms at any time on this page. We may update, change or replace any part of them by posting the change to our website. It is your responsibility to check this page periodically. Your continued use of or access to our website or the Service after a change is posted constitutes acceptance of that change.
